Waiver and Release

Please Read & Fill Out This Agreement

This PHOTO RELEASE AGREEMENT (the “Agreement”) is made as of 07/24/2022 (the “Effective Date”) by and between Rocky Mountain Dachshund Rescue (the “Releasee”), located at PO Box 522461, Salt Lake City, Utah 84152, and (the “Releasor”), located at (the “Releasor Address”). The Releasee and Releasor may be referred to individually as the “Party”, or collectively, the “Parties”.

I, (“Releasor”), located at (the “Releasor Address”) hereby agree and consent as follows:

A. I consent and authorize Rocky Mountain Dachshund Rescue, located at 1953 S 1100 E, Unit 522461, Salt Lake City, UT 84152 (“Releasee”), to use:

My likeness, image, and appearance: (“Releasor”)
The likeness, image, and appearance of my minor child (under 18 years of age): (the “Releasor’s Child’s Name”)

in any photographs or videos (“Photos”) taken during events, pet adoptions, pet meet and greets, activities, programs, or functions hosted, sponsored, or associated with Rocky Mountain Dachshund Rescue, as well as Photos voluntarily provided to Releasee (including those taken outside of events, such as at home).

Clarification: Consent is only required from the individuals (or their legal guardians) depicted in the Photos. The consent of the photographer is not required if they are not identifiable in the image.

B. Grant of Rights
I grant the Releasee the irrevocable right to use the Photos for lawful commercial purposes, including but not limited to advertising, promotion, marketing, or trade, in any format or publication, whether print or web-based. This consent applies globally, is not limited by time, and includes the right to copy, edit, enhance, crop, or otherwise modify the Photos as needed. I also waive any right to inspect or approve the final product featuring the Photos.

C. Ownership of Photos
I understand and agree that all Photos, including any derivative works, are the exclusive property of the Releasee, and I do not retain any ownership or intellectual property rights to the Photos.

D. Compensation
I acknowledge that I am not entitled to any compensation, royalties, residuals, or any other form of payment in connection with the Photos.

E. Voluntary Provision of Photos
I acknowledge that I may voluntarily provide Photos to Releasee (including those taken at home or in other non-event settings), and that such Photos are covered by this Agreement once submitted.

F. Release of Liability
I agree to release and forever discharge the Releasee, its affiliates, successors, assigns, officers, employees, representatives, partners, agents, and anyone claiming through them, in their individual and/or corporate capacities, from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature or kind, known or unknown, which I, or anyone claiming on behalf of me, may have or claim to have against the Releasee in connection with the use of the Photos.

By signing below, I, (“Releasor”), represent that:

G. I am at least 18 years of age and have full legal capacity to execute this Photo Release Agreement, and if I have listed a minor, I am their parent or legal guardian and have the legal authority to execute this Photo Release Agreement on their behalf.

H. I have carefully read and fully understand all the provisions of this Photo Release Agreement and am freely, knowingly, and voluntarily signing.

I. This agreement shall be governed by the laws of the state of Utah. Any disputes arising from this agreement shall be resolved in the appropriate courts of the state of Utah.

J. If any provision of this Photo Release Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
